If a foreigner intends to stay in the country for longer than 90 days, they must obtain a temporary residence permit (TRP) within the prescribed timeframe. This requirement applies to anyone planning a long-term stay and must be completed within 90 days from the date of entry.
The permit is issued for a period corresponding to the duration of the employment contract concluded with the Kazakhstani employer. The maximum validity period of a TRP is limited to one year, but the law allows for multiple extensions of the permit while maintaining the employment relationship.

The above rules do not apply to two categories of foreigners:

Current residency requirements:
- For citizens of the EAEU states, the permitted period of stay without additional documents is 90 days within any 180-day period.
- For citizens of other countries enjoying a visa-free regime (non-EAEU members), a limit has been established: no more than 30 days continuously, but no more than 90 days in total over the same 180-day period.
Who is exempt from these restrictions?
The above rules do not apply to two categories of foreigners:
- Persons who entered Kazakhstan on the basis of a visa – the period of their legal stay is determined by the expiration date of the visa.
- Foreigners who already have a valid temporary residence permit (TRP) or permanent residence permit (PR) in the Republic of Kazakhstan – these limits do not apply to them, as their status has already been settled.

Validity period of the temporary residence permit
The validity period of a temporary residence permit is determined by the duration of the current employment contract concluded with the foreign worker. The maximum permitted period for issuing a temporary residence permit is one year. If the term of the employment contract is less than one year, the temporary residence permit is issued for the corresponding shorter period specified in the contract.
Family members
Family members of a foreign worker who has signed an employment contract in the Republic of Kazakhstan, namely their spouse and children, are eligible to apply for a temporary residence permit. The validity period of the temporary residence permit for this category of individuals is identical to the permit issued to the main applicant. The list of required documents includes notarized copies of the marriage certificate and children's birth certificates, apostilled or legalized in accordance with the established procedure. Children under 16 years of age are exempt from the requirement to obtain a separate temporary residence permit.
