How the Business Immigrant TRP Works for EAEU Citizens
Let us refer to paragraph 2 of Article 40 of the Law of the Republic of Kazakhstan "On Population Migration." It directly states: the creation of a legal entity, as well as participation in the authorized capital of commercial organizations, is prohibited for foreigners who have not obtained an entry visa or a temporary residence permit as business immigrants.
The law clearly separates two categories of foreigners:
If we look at substance rather than form, the business immigrant TRP for an EAEU citizen is a complete analogue of the C5 visa. Both documents confirm the same thing: their holder has the right to engage in entrepreneurial activity on the territory of Kazakhstan, including the creation of companies and participation in their authorized capital.
The difference lies only in the procedure for obtaining it. A citizen of a visa country goes through all stages before entry: gathers documents, receives an invitation, applies to the consulate, waits for a decision. An EAEU citizen enters freely but is then obliged, within a limited period (while the visa-free period is valid), to submit documents for a TRP directly at the migration service of Kazakhstan.
